These Terms of Service (“Terms”) govern your use of Smart Support, an AI-powered customer support and social media management platform operated by Power Moves Development LLC (“we,” “our,” or “us”).

By accessing or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please discontinue use of our services immediately.

Voice Call Management

  • • AI-powered call routing
  • • Automated customer support
  • • Call transcription and analysis
  • • Integration with LiveKit services

Business Integrations

  • • CRM system connections
  • • Calendar and scheduling integration
  • • Property management system support
  • • Custom workflow automation

User Responsibilities

Account Security

  • • Maintain the confidentiality of your account credentials
  • • Use strong passwords and enable multi-factor authentication
  • • Notify us immediately of any unauthorized access
  • • Regularly review account activity and settings

Acceptable Use

  • • Use services only for legitimate business purposes
  • • Comply with all applicable laws and regulations
  • • Respect intellectual property rights
  • • Maintain professional communication standards

Data Management

  • • Ensure accuracy of information provided to AI agents
  • • Regularly backup important conversation data
  • • Monitor AI responses for quality and appropriateness
  • • Comply with privacy laws regarding customer data

Prohibited Activities

Content Violations

  • • Spam, harassment, or abusive content
  • • Hate speech or discriminatory language
  • • Adult content or inappropriate material
  • • False, misleading, or deceptive information

Technical Misuse

  • • Attempting to hack or breach security
  • • Reverse engineering our software
  • • Excessive API usage or rate limit violations
  • • Interfering with service functionality

Legal Violations

  • • Copyright or trademark infringement
  • • Privacy law violations (GDPR, CCPA, etc.)
  • • Fraudulent or illegal activities
  • • Unauthorized data collection

Commercial Misuse

  • • Reselling or redistributing our services
  • • Creating competing products using our AI
  • • Bulk account creation or automation
  • • Circumventing usage limitations

Service Availability & Performance

Uptime Commitment

We strive to maintain 99.9% uptime for our services, with the following provisions:

  • • Scheduled maintenance windows with advance notice
  • • Emergency maintenance for security or critical issues
  • • Third-party service dependencies (Microsoft Azure, OpenAI)
  • • Force majeure events beyond our reasonable control

AI Service Limitations

While our AI agents are highly capable, users should understand:

  • • AI responses may occasionally be inaccurate or inappropriate
  • • Human oversight is recommended for sensitive interactions
  • • Performance may vary based on conversation complexity
  • • Training data has temporal limitations

Platform Integration Dependencies

Our service integrations depend on third-party APIs and may be affected by:

Intellectual Property Rights

Our Intellectual Property

Smart Support and all related technology, software, and content are owned by Power Moves Development LLC, including:

  • • Software code, user interfaces, and system architecture
  • • Trademarks, logos, and brand materials
  • • Documentation, guides, and educational content

Your Content Rights

You retain ownership of content you input into our system, while granting us necessary rights to:

  • • Store conversation histories and customer interactions
  • • Improve AI models with anonymized, aggregated data
  • • Generate responses and automated communications

AI-Generated Content

Content generated by our AI agents is subject to the following terms:

  • • You may use AI-generated content for your business purposes
  • • You are responsible for reviewing and approving AI responses
  • • We do not claim ownership of AI-generated customer communications
  • • You indemnify us against claims arising from AI-generated content

Limitation of Liability

IMPORTANT: PLEASE READ THIS SECTION CAREFULLY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POWER MOVES DEVELOPMENT LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF SMART SUPPORT.

AI Service Disclaimers

  • • AI responses are provided “as is” without warranties
  • • We are not liable for inappropriate or inaccurate AI responses
  • • Users are responsible for reviewing AI-generated communications
  • • AI training data may contain biases or outdated information

Integration Limitations

  • • Third-party platform changes may affect functionality
  • • We are not responsible for social media platform policies
  • • Integration performance depends on external APIs
  • • Data loss during platform migrations is not covered

Maximum Liability Cap

Our total liability for any claims shall not exceed the amount paid by you for Smart Support services in the 12 months preceding the claim.

Account Termination

User-Initiated Termination

  • • Cancel your account at any time through settings
  • • Export your data before termination
  • • Outstanding payments remain due
  • • AI agents will be deactivated immediately

Service-Initiated Termination

  • • Violation of these Terms of Service
  • • Abusive or inappropriate behavior
  • • Non-payment of fees
  • • Legal or regulatory requirements

Data Retention After Termination

Upon termination, we will retain your data for 30 days for potential account restoration, after which it will be permanently deleted unless required by law to retain longer.

Governing Law & Dispute Resolution

Applicable Law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Miami-Dade County, Florida.

Arbitration Agreement

For disputes involving claims under $10,000, you agree to resolve disputes through binding arbitration rather than in court, except for:

  • • Injunctive relief requests
  • • Privacy or data protection violations

Terms Updates

We reserve the right to modify these Terms of Service at any time. Material changes will be communicated via email and prominent platform notice at least 30 days before taking effect. Continued use of Smart Support after the effective date constitutes acceptance of the updated terms.

If you do not agree to the updated terms, you must discontinue use of our services and may terminate your account as outlined in the Termination section.
